The "ius soli" has a not insignificant social value
Lo "Ius soli" is a citizenship law, passed by the House at the end of 2015. And it has been waiting to be examined by the Senate ever since. The law expands the criteria for obtaining Italian citizenship. It mainly concerns children born in Italy to foreign parents or who arrived in our country as children.
According to a study by the Leone Moressa Foundation on Istat data, currently in Italy there are about one million and sixty-five thousand foreign minors. Many children of parents who have long lived in the country.
The two new criteria of the "ius soli"
The new rule would introduce two new criteria for obtaining the status before the age of 18. The "ius soli temperato ", right linked to the territory "and "Ius culturae", right related to education.
The pure "ius soli" instead provides that those born in the territory of a certain State automatically obtain citizenship. As it happens, for example in the United States. But it is not foreseen in any state of the European Union.
The "temperate", envisaged in the bill presented to the Senate, provides that a child born here automatically becomes Italian if at least one of the two parents has been legally in Italy for at least five years.
The other way to obtain citizenship is the "ius culturae". It passes through the school system. Foreign minors born in our country or arrived within 12 years of age who have attended schools in Italy for at least 5 years may apply for Italian status.
The "ius sanguinis"
A reform of citizenship has been under discussion for about 13 years. The objective is to modify the current law, the 91 of 1992, which provides for the "ius sanguinis".
Italian citizenship is only passed on from parents to children.
The foreign citizen born in Italy today has the right to citizenship only if, once of age, they declare within one year that they want to acquire it. And until that moment he resided in the country "legally and continuously".
